台灣高等法院駁回前總統陳水扁保外就醫抗告案，陳水扁的兒子陳致中在臉書上表示，這是法院和法務部所持法律見解的歧異問題，法務部是主管官署，必須自己決定。

陳致中在臉書PO文指出，高院駁回保外就醫案抗告的理由，是本案應該去行政法院打行政訴訟，這顯然是法院與法務部所持法律見解的歧異問題，與保外就醫案實體無涉，大家可以去討論；但老實說對於本案的實益不大，打行政訴訟更是曠日廢時。

他強調，陳水扁的病情不能再拖，法務部身為主管官署，必須自己決定，絕無推給法院之理。
