誤導扁提聲請異議？法務部：沒有錯

台灣高等法院今天駁回陳水扁的聲明異議，並指對矯正署的處分不服，應打行政訴訟，不是提刑事的聲明異議，指法務部誤導前總統陳水扁。

法務部對高院的看法表示反對。法務部發新聞稿指出，高院引用的大法官解釋是針對假釋案，不是保外就醫，兩者情形不同；且最高行政法院去年一個判決指出，刑罰執行方法的爭議與刑事訴訟法具有關連性，爭議的解決方法未必是靠行政訴訟；而且台北地方法院在上一個駁回裁定指出，應向判決法院（即台灣高等法院）提出救濟，也沒有指明要打行政訴訟，因此法務部認為前總統陳水扁可向高等法院提聲明異議並沒錯。

法務部強調，雖然高等法院對法律訴訟程序有不同見解，如果陳水扁不服，仍然可以提抗告或照高院看法提行政訴訟。至於陳水扁重新提出的保外就醫聲請已經交給矯正署處理中，高院昨天的裁定不影響矯正署將來的決定。
